Height, Placement and the HOA
A residential fence inside the required front setback is limited to 48 inches; anywhere else on the lot the cap is 10 feet, measured from adjacent grade. Fences up to 7 feet are exempt from a City building permit, so a standard 6-foot or 8-foot cedar fence usually is not, and the 8-foot one needs a permit.
If you're in an HOA, Texas law has barred associations from prohibiting a perimeter fence since 2021 (Property Code §202.023). The association can still regulate the type of fence. A 2025 amendment (SB 711) added what else it can restrict: fencing over sidewalks or drainage easements, a 10-foot driveway-gate setback on laned roads, and, if the covenants say so, fencing in front of the house's front-most building line. Bring us your HOA's fence guidelines and we'll match the style they approve.
